MadeSweeter.com (the “Site”) is operated by Savage Wine, LLC (“MadeSweeter,” “we,” “us,” or “our”). These Terms of Use govern your access to and use of the Site.
By visiting, browsing, submitting an inquiry through, or otherwise using the Site, you agree to these Terms of Use. If you do not agree to these Terms, please do not use the Site.
Purpose of the Site
MadeSweeter is an informational, product-discovery, and lead-generation website for customized gifts, food gifts, chocolates, promotional products, packaging, and related products and services.
Unless expressly stated otherwise, MadeSweeter.com is not an ecommerce storefront, and submitting an inquiry, request for information, or request for a quote through the Site does not constitute an order, purchase, contract, or acceptance of an offer.
Product Information, Pricing and Availability
We make reasonable efforts to provide useful and accurate product information. However, products displayed on the Site may be manufactured, supplied, decorated, packaged, or fulfilled by third parties, and product details may change without notice.
Accordingly, all product descriptions, photographs, dimensions, colors, materials, packaging, ingredients, specifications, minimum quantities, production times, availability, pricing, and other information displayed on the Site are provided for general informational purposes and are subject to confirmation.
Any pricing shown on the Site, including “starting at,” “from,” estimated, sample, volume, or illustrative pricing, is not a binding offer. Actual pricing may depend on quantity, customization, artwork, packaging, setup charges, shipping, delivery location, production schedule, taxes, supplier pricing, and other project requirements.
A binding price, scope, and production commitment exists only when confirmed in a written quotation, proposal, invoice, order acknowledgment, or other written agreement issued or accepted by us.
Product Images and Samples
Product photography is intended to illustrate the general appearance and customization possibilities of the products shown. Actual products may vary in color, size, finish, packaging, decoration, configuration, or other details.
Computer and mobile displays may also reproduce colors differently. Where exact appearance, color, dimensions, packaging, or material is important, you should request confirmation or a physical sample where available before placing an order.
Third-Party Products and Suppliers
Many products shown or described on MadeSweeter.com are produced or supplied by independent manufacturers, suppliers, decorators, fulfillment providers, or other third parties.
MadeSweeter may select, source, recommend, customize, combine, package, or coordinate such products as part of a customer project. Inclusion of a product on the Site does not guarantee that the product will remain available.
We reserve the right to recommend or substitute comparable products when a displayed product is discontinued, unavailable, materially delayed, or otherwise unsuitable for a particular project. Any material substitution for a confirmed order will be addressed with the customer as appropriate.
Quotes, Orders and Contracting Entity
An inquiry submitted through MadeSweeter may result in a quotation, proposal, or order that is issued by Savage Wine, LLC or through an applicable business name or brand operated by Savage Wine, LLC, depending on the nature of the product, service, or project.
The terms contained in an accepted proposal, quotation, invoice, purchase acknowledgment, or other written agreement governing a particular transaction will control over these general Site Terms to the extent of any conflict relating to that transaction.
Customer Artwork, Logos and Other Materials
You may have the opportunity to provide logos, trademarks, photographs, designs, artwork, text, names, messages, or other materials (“Customer Materials”) for use in preparing concepts, proofs, customized products, packaging, or other project materials.
You retain whatever ownership rights you have in your Customer Materials. By providing Customer Materials to us, you grant Savage Wine, LLC and its suppliers, contractors, designers, decorators, printers, production partners, and fulfillment providers a limited, non-exclusive license to reproduce, modify, format, transmit, display, and otherwise use those materials solely as reasonably necessary to quote, design, proof, produce, fulfill, or administer your requested project.
You represent and warrant that you own or have obtained all rights, licenses, permissions, and authorizations necessary for us to use Customer Materials as requested, and that such use will not infringe or violate the intellectual-property, privacy, publicity, or other rights of any third party.
We reserve the right to refuse to reproduce or use material that we reasonably believe may be unlawful, infringing, defamatory, deceptive, obscene, or otherwise inappropriate.
Proofs and Customer Approval
For projects involving customization, you may be provided with an electronic or physical proof before production.
You are responsible for reviewing proofs carefully, including spelling, names, dates, logos, colors, layout, quantities, and other project details. Unless otherwise agreed in writing, production may proceed after customer approval, and the customer is responsible for errors appearing in an approved proof.
Intellectual Property
Except for third-party materials and Customer Materials, the Site and its contents, including text, graphics, design, layout, logos, icons, photographs, illustrations, software, and other materials, are owned by or licensed to Savage Wine, LLC and are protected by applicable copyright, trademark, and other intellectual-property laws.
You may view and use the Site for legitimate informational and business purposes. You may not reproduce, republish, distribute, modify, scrape, systematically extract, sell, commercially exploit, or create derivative works from substantial portions of the Site without our prior written permission, except as otherwise permitted by law.
Third-Party Names, Trademarks and Content
The Site may display names, trademarks, logos, photographs, product images, designs, or other materials owned by manufacturers, suppliers, customers, or other third parties. Those materials remain the property of their respective owners.
Their appearance on the Site does not imply that MadeSweeter owns those marks or that any third party sponsors or endorses MadeSweeter, except where an affiliation is expressly stated.
Examples of customized products displayed on the Site may illustrate prior work, supplier capabilities, or possible customization techniques and should not be interpreted as an endorsement by the owner of any trademark appearing in an example unless expressly stated.
Permitted Use of the Site
You agree not to:
- Use the Site in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Site, its servers, systems, accounts, or nonpublic areas;

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, AND FUNCTIONALITY AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAVAGE WINE, LLC, MADESWEETER, AND THEIR OWNERS, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE.
THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Savage Wine, LLC, MadeSweeter, and their owners, affiliates, representatives, contractors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

- Your Customer Materials;
- Your violation of applicable law; or
- Your infringement or violation of the rights of another person or entity.
Changes to the Site and These Terms
We may modify, suspend, discontinue, or change any portion of the Site at any time without notice.
We may also update these Terms of Use from time to time. Revised Terms become effective when posted on the Site, unless otherwise stated. The “Last Updated” date above indicates when these Terms were most recently revised.
Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.
Governing Law
These Terms and your use of the Site are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
Entire Agreement
These Terms, together with our Privacy Policy and any additional terms expressly applicable to a particular Site feature, constitute the agreement governing use of the Site.
For an actual purchase, custom project, or service engagement, the applicable written quotation, proposal, invoice, order acknowledgment, or other agreement may contain additional terms and will govern that transaction as provided in that document.
